Drafting & Transactions

Unusually for a barristers chambers we also specialise in transactional, i.e. non-litigation, work.  Stuart Cakebread has written a much used practitioners’ book on drafting commercial contracts, a new edition of which he is in the process of completing, and has taught and lectured extensively on the subject. We believe that this expertise, combined with our extensive litigation experience as commercial barristers, gives us a unique ability to ensure that when drafting or advising clients on contractual or other matters we are aware of the pitfalls which may lead them to future unwanted litigation as well as ensuring that their commercial interests are properly advanced and protected.

Instructing Us

  • Members of the public and commercial and non-commercial organisations, can now instruct barristers directly under the Direct Access Scheme. Further details of the the Scheme can be found via the Bar Standards Board website, our regulatory body. Please click here for further detail.

All members of Cerulean Chambers have been approved by the Bar Council to accept work under the Direct Access Scheme and are licensed to conduct litigation through the BSB. In such cases, a retained solicitor isn’t required in order to instruct members. They can be approached through our Senior Clerk.

Our clerks are more than happy to discuss fees and provide tailor-made packages for clients. We appreciate that litigation is a costly process for clients, regardless of their financial situation, and are happy to assist clients with any ATE and Litigation Funding requirements they may have.

  • Members of Cerulean Chambers accept instructions from in-house lawyers for both our contentious and non-contentious services. If the issue moves from pre-litigation planning to litigation we can also assist as we are fully licensed to conduct all aspects of litigation through the BSB.

We also accept instructions from licensed organisations or individuals. Under the Licensed Access scheme, those with the necessary expertise and experience can instruct barristers directly. Further details of the Licensed Access scheme can be found via the Bar Standards Board website – the body which runs this scheme. Please click here for further detail.

Our Senior Clerk will be happy to help with any aspect of in house/licence access queries.

  • Members of Cerulean Chambers are highly experienced in working closely with lawyers from different jurisdictions. We will happily travel abroad if required and Stuart Cakebread has been called to the British Virgin Islands (BVI) bar.

For the majority of cases you will be able to instruct members directly. If it is appropriate for you to instruct a member through a solicitor, we can assist you with this process and are happy to suggest suitable firms from either our own solicitor base, or others, depending on your needs.

  • Solicitors can instruct us either through our clerk or by contacting the barristers direct. Since we are focused on your needs, if we cannot offer a suitable barrister from our own members, or the case requires a diverse team, we will not hesitate to recommend counsel from other chambers.

Our clerks are more than happy to discuss fees and provide tailor-made packages for clients. We appreciate that litigation is a costly process for clients, regardless of their financial situation, and are happy to assist clients with any ATE and Litigation Funding requirements they may have.
